this is her response to a email i sent checking to see if she had received it.

Yes the camera arrived on Saturday and unfortunately, we are very disappointed.

The camera appears to have had something spilled on it (specifically the mode switch - it seems sticky and very slow to respond). Also, it's apparent by the indentions around the lens that it has been dropped. The other big concern is that the LCD screen has been damaged in some way because it has a bluish-green hue at all times so it can't be used to adjust exposure, white balance, or any other critical settings that are needed to adjust for recording to get the proper picture/video. Also, just a minor note, the back of the LCD screen has numerous scratches on it. Obviously, with these problems, the camera is not "like new" as advertised and definitely makes me concerned that there will be other future problems with the unit.

With this said, the camera is not "like new" as quoted/advertised on the auction and I want to return it.

Do apologize and hate that this didn't work.



so theres one scratch on the back of the lcd which is visible in the picture possibly two?. i have no clue what shes talking about with the scratches on the lens and the hue and such. like the listing said i've used it maybe 10 hours probably less, the camera is fine..what do i do? i asked her to take pictures of the problem areas and send them to me.

looks almost mint condition to me...if you used it for only 10 hours and didnt notice any of the lcd color problems shes experiencing then it must be some defective problem

Did you pack it properly before shipping? Those packages go through hell when they are being shipped.

tell her your not responsible for anything that happens during shipping and she should have purchashed shipping insurance. those pics look home taken and assure her they left that way.

i put shipping insurance on it thank god i took those pics. if she wants to file something through them thats fine by me. but in all honesty i cant afford to refund the money right now and i really dont want to give a refund. i really dont think theres much she can do those pictures show everything looking/working properly and i really dont know wheres she coming from with the white balance hue shit but whatever. ebay wont do anything will they?

Heres how it went down, she had the same camcorder, and it was messed up, then she said here ill buy this get the good camcorder, then tell him that something is wrong and send it back. She pays shipping 2 ways. And has a "Like new" Camcorder.

Hi Cody,

I have attached a few pictures for you to look at. I have also taken some with another camera so you can compare and see the real difference. While the pictures are hard to see, I hope you can tell the difference. I have included a little bit of a description so that you can tell what you should be seeing. The pictures don't do it justice but hopefully you can get a jist of what I'm seeing for real.

Looking at your camera beside mine, you cannot determine the colors; they have a bluish green hue - very muted colors.

It was extremely hard to take photos of the LCD screens so I hope they are helpful in describing the problems. If you have some other ideas of how I can demonstrate this to you, I will be more than happy to. I want us both to be treated fairly.

The auction stated a seven day return period - just want to be sure that we resolve this so that I am within the time limit to return if that is what we decide to do. Really hate to let the camera go, but the camera in the condition it is, does not warrant the premium price I paid.

Would you like for me to return the camera or would you like to discuss a lower price for it. Again, open to suggestions; want to be fair to the both of us.

oh and i emailed her back...im pretty sure if that is my camera by any chance its probably due to the fact that she turned the night vision on somehow and didnt realize it. either way shes not getting her money back, way too sketchy for me

The worst-case scenario is that she will give you negative feedback. It sounds like she is just a lying whore. I would write her back and tell her to go to hell because the camera was in good condition when you shipped it.

yeah, sounds like a scam

she screwed up her own camera, bought the same model and is trying to give you her old one while keeping your good one while getting her money back (i wouldnt imagine "spilling shit on the camera" is covered by most warranties), just because she sounds nice, doesnt meen she isnt trying to screw you over

EDIT: The ONLY way i would refund her money is to have her return the camera to you and you somehow confirm that it is without a doubt your camera and figure out what is wrong with it, then i would consider refunding it, if she doesnt trust you enough to do that, then it makes it her problem

Simple idea: the serial numbers of the cameras are on the bottom. Take camera A and use it to videotape the quality of the LCD screen of camera B. After the LCD screen has been assessed, keep filming and rotate camera B to reveal its serial number underneath.

Then do the opposite, camera B record the LCD and the serial # of camera A.

Have them convert the 2 videos to .avi and send them to you.

ha, so ive been busy lately havent been checking my emails..i ended up getting 3 from her in 3 days which all basically say "we would like to return the camera where should we send it" then she got a lil more pissy and said "if you dont respond we'll contact ebay and our credit card company". so i sent her one back saying i would send her all of the insurance information if she'd like but im not giving her her money back and getting a broke camera in return. i have a feeling shes not too happy

"Not sure what you are saying. I do not recall receiving an email re: insurance papers. The camera was not damaged during shipping so insuring isn't an issue. You stated in your auction - "a like new camera" that obviously has cosmetic as well as functional defects. You knew the camera had these defects when you put it up for auction; it had nothing to do with shipping; I have the original box/package the camera came in and there is absolutely no signs of damage or stress to the package and I will be happy to ship this in another box so that you can be assured of that. You were told the morning after we received the camera of these defects so you were promptly alerted. You are dealing with someone that is willing to work with you; anyone else would have already complained to eBay. etc. I requested a compromise or requested to return the camera as a 7 day return policy that was stated in the auction. You get the same camera you sent to me and I get my money returned. We will have what we had before the transaction. I want to resolve this on good terms. I have tried to work with you. I wish to give you the camera you shipped to me and I would like my money returned. If you wish to do differently, I will start the legal actions with eBay and my credit card company. I would rather not go to those extremes. I'm just asking for each of us to return what was ours originally. Let's resolve this reasonably. Your call. Thank you."

First off I wouldn't have followed up with you so promptly(3 days after mailing) after the auction to see if you received the camera if i had sent you a broken camera, i also would not have asked you to remember to leave me feedback if i was selling you a broke camera. i did not send you a broke camera. you keep pointing to the "like new" statement as if that guarentees a perfect camera upon delivery. As the auction stated 10 hours of use MAYBE, i know there has been no more than that. please dont accuse me of sending you a broke camera b/c i can guarentee you that it was not. i think its very unreasonable to assume that i sent you a broke camera and then ask for the money back so then i am out a functional camera and the money...like i said i put shipping insurance on the camera for this reason. if you feel like you need to contact ebay and your credit card company i guess that is up to you. You are dealing with a 100% honest ebayer who is actually taking the time to try and get this resolved as well. please dont assume that im just some punk trying to get over on you. i sent you a working camera, never had any issues with it at all. like i said to me, it looks like the night vision button is slid forward but as you said you've checked this it must not be it. dont look so one sided at this, you say you're reasonable..try and realize where im coming from as well. I put up a christmas present from my father b/c im in college and hard up for money, now this person that i dont know is saying i sent them a broken camera when i know i didnt and want to get their money back and give me a broke camera in return. thats a little hard to swallow. like i said i'd love to get this resolved, and the camera was shipped fine (and insured) so its up to you how you want to procede.

Just my personal opinion but if you aren't just e-mailing your friends/family but rather a disgruntled eBay customer I'd try to use proper grammar/sentence structure when you are exchanging e-mails.

why doesn't she just file a claim with the shipping company? i think it sounds like she would have a good case to get some money out of it - or you could get the money, and send it to her, or something. I have no idea how that would work...but at least you could shut her up, and not have to take a direct hit to your wallet.

yeah i know i should be a little more formal with her i just wrote her that before i headed to class..i've been kinda of keeping the 2 camera thing in my back pocket in case she does try something. i contacted ebay this morning after my class as well. i know im not at fault, how much can she really do?

This should teach you to put a 7 day return on a used item. She obviously is trying to exploit that fact and pull one over on you. Don't let people like this walk all over you. There is really nothing she can do. And you need to get on this serial number thing. That is by far your strongest arguement... you have a picture where most of the number is visible. Ask her to take a picture of the broken camera from more angles. Maybe you can trick her into giving you a shot of the broken cameras serial number. Then just match them up.

how about have her take a picture of the borked cameras menu, just like the picture that you have on the ebay auction. You should be able to tell if it looks different than it did when you took the picture. The borked camera she took the picture of was pretty fucked up. If it is tell her to look at the picture that you took for the ebay auction and tell her that it was fine before it was sent.
